Terms of Service

These Terms of Service (“Terms”) govern your access to and use of enso (“enso,” “we,” “us,” or “our”), a custodial copy-trading platform that lets you fund an account and copy the strategies of other traders. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into these Terms to use the Service. You may not use the Service if you are located in, or are a resident or national of, a country or region subject to comprehensive sanctions, or if you are on any applicable sanctions or restricted-persons list, or where your use would be illegal. You are responsible for complying with the laws that apply to you, including tax laws.
2. The Service
enso provisions and operates blockchain wallets on your behalf and gives you tools to deposit funds, copy the strategies of other traders and curated collections, trade yourself, and withdraw. Trades are executed on a third-party perpetual-futures exchange and settle on public blockchain networks. We may add, change, or remove features at any time.
3. Accounts and custody
The Service is custodial. We create and operate the wallets used for your account, and you authorize us to move your funds and place trades as needed to carry out the actions you initiate through the Service.
- You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately of any unauthorized use.
- Withdrawals are sent only to addresses you have approved. You are responsible for the accuracy of any withdrawal address you provide. Blockchain transactions are irreversible.
- You are responsible for sending only supported assets on supported networks when funding your account. Funds sent on the wrong network or in an unsupported token may be lost.
4. Risk disclosure
Trading crypto assets and derivatives is highly risky and can result in the total loss of your funds. Only use funds you can afford to lose. By using the Service, you acknowledge and accept the following risks:
- Market risk. Prices are volatile and can move sharply against you. You may lose some or all of your deposited funds.
- Leverage and liquidation. Perpetual futures can be traded with leverage, which magnifies both gains and losses and can lead to rapid liquidation of your positions.
- Copy-trading risk. When you copy a trader or a collection, your account follows decisions made by others. Past performance does not guarantee future results, a trader you copy may lose money, and results shown may be historical or simulated and are not a promise of returns.
- No advice. enso does not provide investment, financial, legal, or tax advice, and nothing on the Service is a recommendation or solicitation to buy, sell, or hold any asset. All decisions are your own.
- Technology and third-party risk. Blockchains, smart contracts, exchanges, bridges, on-ramps, and other third-party systems can fail, be exploited, be delayed, or become unavailable, which may affect your funds or your ability to transact.
- Regulatory risk. Laws affecting crypto assets are evolving and may change in ways that affect the Service or your use of it.
5. Fees
You agree to the fees disclosed in the Service, which we may update from time to time. These may include a performance fee (a share of profits) on strategies you copy, a subscription fee for certain plans, and any network, exchange, or payment-provider fees incurred to carry out your transactions. Where you participate as a lead trader or in a referral program, the applicable revenue-share terms are disclosed in the relevant part of the Service. We will make reasonable efforts to show fees clearly before you incur them.
6. Deposits and withdrawals
You can fund your account with supported crypto assets and, where available, by card or bank transfer through our payment partner. On-ramp and bridging services are provided by third parties and are subject to their terms and identity checks. Processing times depend on networks and providers and are not guaranteed. You can withdraw available funds to an approved address, subject to security checks and any conditions described in the Service.
7. Acceptable use
You agree not to:
- use the Service for any illegal purpose or in violation of any applicable law;
- engage in market manipulation, fraud, money laundering, or the financing of illegal activity;
- provide false information, impersonate others, or use the Service on behalf of a sanctioned or restricted person;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or disrupt or interfere with the Service;
- reverse engineer, scrape, or misuse the Service except to the extent this restriction is prohibited by law; or
- circumvent any security, rate-limiting, or access control.
We may suspend or terminate access, and take other appropriate action, if we reasonably believe you have violated these Terms or created risk or legal exposure for enso or others.
8. Third-party services
The Service relies on third parties, including a third-party exchange and trade-execution infrastructure, authentication and custodial wallet providers, payment and on-ramp providers, security providers, and the underlying public blockchain networks. Your use of the Service may be subject to those providers' own terms and policies, and we are not responsible for their acts, omissions, or availability.
9. Intellectual property
enso and its licensors own the Service, including its software, design, and brand. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law or with our written consent.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any result or return will be achieved. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, enso and its affiliates, and their respective officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or funds, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless enso and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Suspension and termination
You may stop using the Service at any time and request to close your account. We may suspend or terminate your access at any time if we reasonably believe it is necessary to comply with law, protect the Service or its users, or address a violation of these Terms. On termination, you remain able to withdraw available funds except where prohibited by law or a valid legal process. Provisions that by their nature should survive termination will survive.
14. Changes to the Service and Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
15. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws applicable where enso operates, without regard to conflict-of-laws principles, except where mandatory local law provides otherwise. You agree to first try to resolve any dispute with us informally by contacting us. The specific governing jurisdiction and dispute-resolution venue will be identified here as enso's operating entity is finalized.
